Terms & Conditions

Article 1. Applicability

These Terms & Conditions apply to all memberships, trials, passes, classes, personal training sessions and other services offered by NABO CrossFit (“NABO”).

By purchasing a membership, pass or other service, the member confirms that they have read and accepted these Terms & Conditions and the applicable gym rules.

NABO may update these Terms & Conditions when reasonably necessary. Members will be informed in advance of significant changes that affect their membership.
Article 2. Memberships

NABO offers different membership options, including:
-
Unlimited monthly membership – maximum one class per day
-
2x Week monthly membership – 9 classes per month
-
6-Month Unlimited membership – maximum one class per day
-
6-Month 2x Week membership – 9 classes per month
-
Punch Card – 10 classes
-
Drop-in – 1 class
-
Trial memberships and promotional memberships where available
-
Personal training and other separately purchased services
2. The conditions, price, duration and number of available classes or credits are shown when purchasing a membership.
3. Memberships are personal and may not be transferred to another person unless NABO agrees otherwise in writing.
4. Classes must be booked through NABO's designated booking system.
5. Credits included in monthly memberships must be used within the applicable membership period and do not carry over to future months unless explicitly stated otherwise.
6. Punch Cards, trials and other credit-based products may have their own validity period. Any unused credits expire at the end of that period.
Article 3. Membership Fees and Payment

Current membership prices are available on the NABO CrossFit website.

Membership fees are collected automatically using the payment method selected during registration.
-
If a membership starts partway through a billing period, the first payment may be adjusted proportionally where applicable.

Members are responsible for ensuring sufficient funds are available for scheduled payments.
-
If a payment fails or remains outstanding, NABO may temporarily suspend the member's ability to book or attend classes until the outstanding amount has been paid.

Reasonable costs resulting from failed payments, chargebacks or collection of overdue amounts may be charged where permitted by law.

If payment remains outstanding, NABO may take further steps to collect the amount in accordance with applicable Dutch law.

NABO may change membership prices. Members affected by a price change will be informed in advance. Any rights a member has under Dutch law as a result of such a change remain unaffected.
Article 4. Membership Period

Monthly Unlimited and 2x Week memberships are entered into for an indefinite period and continue automatically until cancelled.

Monthly memberships can be cancelled with one full calendar month's notice.

A 6-month membership is entered into for the agreed minimum period of six months.

The conditions that apply after the initial 6-month period will be stated when the membership is purchased and will comply with applicable Dutch consumer law.

Punch Cards, trials, Drop-ins and other fixed-term products expire at the end of their stated validity period.
-
If a former member purchases a new membership after their previous membership has ended, this will be treated as a new membership under the conditions and prices applicable at that time.
Article 5. Cancelling a Membership
Cancellation by the member
-
Monthly memberships can be cancelled with one full calendar month's notice.

Cancellation must be submitted in writing by email to info@nabocrossfit.com.
-
The membership remains active and payable until the end of the notice period.
-
Fixed-term memberships cannot normally be cancelled before the agreed end date unless required by applicable law or otherwise agreed by NABO.
Cancellation by NABO
NABO may suspend or terminate a membership where a member:
-
Seriously or repeatedly violates the gym rules or these Terms & Conditions
-
Behaves aggressively, dangerously, discriminatorily or otherwise inappropriately towards members, coaches or staff
-
Deliberately damages NABO property
-
Repeatedly fails to pay membership fees
-
Creates a serious safety risk for themselves or others
Where reasonably possible, NABO will first provide the member with a warning and an opportunity to resolve the issue. In cases of serious misconduct or immediate safety concerns, NABO may suspend or terminate access immediately.
Article 6. Changing a Membership

Members may request to upgrade or downgrade their membership by contacting info@nabocrossfit.com.
-
Changes to monthly memberships normally take effect from the next billing period.

Changes to a fixed-term 6-month membership are subject to approval by NABO and the conditions of that membership.
-
Any difference in membership fees resulting from an upgrade may be charged from the date the new membership becomes effective.
Article 7. Class Bookings, Cancellations and No-Shows
Classes must be booked and cancelled through the Wodify app.
Classes starting before 12:00 must be cancelled before 22:00 the evening before.
For example:

Tuesday 07:00 class → cancel before Monday 22:00
-
Saturday 11:00 class → cancel before Friday 22:00
Classes starting from 12:00 onwards must be cancelled at least two hours before the class starts.
For example:
-
12:00 class → cancel before 10:00
-
19:00 class → cancel before 17:00
A late cancellation fee of €5 applies when a booking is cancelled after the applicable deadline.
A €10 no-show fee applies when a member books a class but does not attend and has not cancelled the booking.
NABO may amend its booking and cancellation policy where reasonably necessary. Members will be informed of significant changes.
Article 8. Health, Safety and Liability

Participation in CrossFit, strength training, conditioning and other physical activities involves inherent risks.
-
Members are responsible for informing coaches of any relevant injuries, limitations or other circumstances that may affect their ability to train safely.
-
Members must follow reasonable instructions from NABO coaches and staff regarding technique, equipment and safety.
-
Members remain responsible for choosing an appropriate level of participation and should stop training and inform a coach if they experience unusual pain, dizziness or other concerning symptoms.

NABO takes reasonable measures to provide a safe training environment and appropriate coaching.
-
NABO is not liable for damage, injury or loss except where NABO is legally liable under applicable Dutch law. Nothing in these Terms & Conditions excludes or limits liability where such exclusion or limitation is not permitted by law.

Members are responsible for damage they intentionally cause or that results from their negligent or improper use of NABO's facilities or equipment.
Article 9. Online Purchases, Refunds and Right of Withdrawal

Where a consumer purchases a membership or service online, any statutory right of withdrawal under Dutch consumer law remains applicable.
-
Where a member expressly requests that a service begins during a statutory withdrawal period, NABO may charge for services already provided where permitted by law.
-
Once a class, Drop-in, trial, Punch Card credit, personal training session or other service has been used, refunds are not normally provided for that used service unless required by law.
-
Refund requests outside statutory rights will be assessed according to the conditions of the product purchased and the circumstances of the request.

Nothing in these Terms & Conditions limits a consumer's mandatory rights under Dutch law.
Article 10. Personal Belongings and Changing Areas

Members are responsible for their own personal belongings while at NABO.
-
Personal belongings should not be left at the gym after leaving the premises.
-
Items left behind may be stored temporarily. NABO cannot guarantee that lost property will be found or retained indefinitely.
-
NABO is not responsible for loss, theft or damage to personal belongings unless NABO is legally liable for that loss or damage.
Article 11. Opening Hours, Classes and Schedule

NABO may change its opening hours, class schedule, coaches, class types or availability where reasonably necessary.
-
Classes or opening hours may be changed or cancelled due to holidays, maintenance, repairs, events, staff availability, safety concerns or other operational circumstances.
-
NABO will make reasonable efforts to inform members of significant or unexpected changes in advance.
-
Membership does not guarantee the availability of a specific class, coach or time slot.
Article 12. Photography and Video

NABO may occasionally take photographs or videos during classes, events or other activities for use on its website, social media and other communications.
-
Where consent is legally required for the use of identifiable images or videos, NABO will obtain the appropriate consent.
-
Members may inform NABO if they do not wish to be photographed or filmed, and NABO will take reasonable steps to respect this preference.

Article 13. Personal Data

NABO processes personal data in accordance with applicable privacy legislation, including the General Data Protection Regulation (GDPR/AVG).

Personal data may be shared with service providers where necessary to operate NABO's services, such as membership management, booking, payment, website, accounting and communication providers.

Article 14. CCTV

Where CCTV is used at NABO, it is used for legitimate safety, security and property-protection purposes and in accordance with applicable Dutch privacy legislation.

CCTV footage will be securely stored and retained only for as long as reasonably necessary, unless footage is required for the investigation of an incident or legal matter.

Article 15. Gym Rules

Members are expected to treat coaches, staff and other members with respect.
-
Equipment must be used responsibly and returned to its designated place after use.
-
Members must follow instructions from coaches and staff where these relate to safety, equipment or the reasonable operation of the gym.
-
NABO may establish or update reasonable gym rules where necessary for safety and the proper operation of the facility.
Article 16. Changes to These Terms

NABO may update these Terms & Conditions where reasonably necessary due to changes in its services, operations, prices or applicable laws.
-
Members will be informed in advance of material changes that affect their membership.
-
Changes will not affect statutory consumer rights.
Article 17. Governing Law and Disputes

These Terms & Conditions are governed by Dutch law.
-
If a member has a complaint or dispute, they are encouraged to first contact NABO at info@nabocrossfit.com so that we can try to resolve the matter directly.
-
If a dispute cannot be resolved, it may be submitted to the competent court in the Netherlands in accordance with applicable law.
